GENERAL:
The ARTIST will have the right to post any updates, Work in Progress (WIP), and finished products on social media, streams, and portfolios unless the CONTRACTING PARTY pays a $100 privacy fee.
The ARTIST has the right to terminate or deny any service without reason. If a piece is terminated after payment, the CONTRACTING PARTY with receive as 50% refund of the total amount PAID to the CONTRACTOR. Please provide as much detail and reference so you may receive the most accurate finished product.The TOS is subject to change at any point in time.PAYMENTS:
Payments Must be made to the ARTIST V or Crypt Dolls. Preferred methods may be discussed with the CONTRACTOR. Partial payments are allowed with discussion. No art will be started until at least 50% of the total cost is paid.REVISIONS:
3 Free revisions are included with every commission. Any revisions after the initial 3 will be subject to a $10-$20 up charge.DEADLINES AND DELIVERY:
Pieces may take UP TO four months to completion-due to personal health, events, or other commissions. Unless CONTRACTING PARTY has paid for expedited delivery. Pricing for expedited delivery may vary on projects, and availability.USE:
I DO NOT permit the use of my art for Artificial Intelligence (AI) or NFTs. The CONTRACTING PARTY may use the artwork provided by the CONTRACTOR for streaming, profile picture, banners, and other social media with the artists name for design credit.All VTuber content has commercial rights automatically added to the total price of anything labeled VTUBER.INTELLECTUAL PROPERTY RIGHTS:
Intellectual property rights are the rights given to persons over the creations of their minds. They usually give the creator an exclusive right over the use of his/her creation for a certain period of time. I CONTRACTOR will maintain IP. However, the CONTRACTING PARTY may use the art purchased for streaming, social media, personal use. If the artwork is to be used on a product to be sold for profit, the artist much be contacted prior for compensation. Artist/Designer credit MUST be displayed somewhere if the art is being used online or on tangible objects.REFUNDS:
Partial Refunds ONLY if there is Justifiable Fault-means any of the following: - negligence or fault or refusal by the CONTRACTOR to fulfill his obligations in virtue of this Contract (other than as a result of total or partial incapacitation due to physical or mental illness); - any action , or omission by the CONTRACTOR which constitutes severe negligence or intentional wrongful conduct relative to the fulfillment of his obligations which may be reasonably expected to substantially damage the reputation, business, or business relationships of the CONTRACTING PARTY.COMMUNICATION:
Every update to the artwork will be sent to the CONTRACTING PARTY for confirmation. If you do not hear from the CONTRACTOR in 2 weeks, please reach out for any updates. The CONTRACTING PARTY is more than welcome to request more updates at any time.
